DIAL-Çelebi Hava Servisi signed the concession agreement on August 24th, 2009.
Çelebi hired top lawyer Mukul Rohatgi and moved the Delhi High Court against revoking its security clearance.
However, the concession agreement with GMR’s Delhi International Airport Limited (DIAL) states that “DIAL may terminate the contract immediately on grounds of national security or following orders from relevant authorities”, ET reported. Relevant authorities include the Indian Government, the authorities appointed publicly, and AAI.
It also states that “if the concession ends on national security grounds, the Concessionaire may remove its equipment at its own cost, with no further payments required from DIAL.”
The agreement mandates that all disputes be resolved under Indian Law and only in Delhi courts.
GMR battled a similar dispute in 2012 when the Maldives government abruptly terminated their airport project because President Mohamed Waheed supported China. GMR won $270 million in damages.
GMR built Istanbul’s Sabiha Gökçen Airport in 2009 and exited the airport in 2013.
